Guidance on Raising a Grievance

  • Formal Process: Advise employees to raise grievances formally and without unreasonable delay, in writing, to a manager who is not the subject of the grievance. The written grievance should clearly state its nature.

  • Drafting the Letter: Guide them to provide relevant factual detail, ensuring accuracy, and to set out different aspects under separate headings for clarity. They should also include details of relevant witnesses and attach any supporting documentation. Emphasize that the letter may become evidence in a tribunal claim.

  • Clarification: If an employee's informal complaint is unclear, advise them to clarify if they intend to raise a formal grievance.

Assistance with Discrimination Claims

  • You can help employees bring a discrimination claim by assisting them in formulating their claim and presenting their evidence effectively. Your expertise can be particularly beneficial for claims related to disability and race discrimination. You offer expert legal analysis and compassionate advocacy to help them navigate the process.

Understanding Tribunal Processes

  • Acas Early Conciliation (EC): Explain that most claims require them to contact Acas for early conciliation before submitting a claim to the tribunal.

  • Presenting the ET1: Guide them on using the standard ET1 form to present their claim clearly and succinctly.

  • Response (ET3) Review: Help them review the employer's ET3 response to identify disputed points and plan for evidence gathering.

  • Preparation: Guide them through preparing for tribunal stages, including case management orders, disclosure of documents, and drafting witness statements.

Support During Investigations

  • Help writing Grievance and Appeal: especially when the grievance concerns an employer's duty.

  • Confidentiality: Advise them that while some information is confidential, they have rights to information about themselves if it forms part of an investigation or claim.

  • Record Keeping: Explain the importance of accurate record-keeping throughout the grievance process.
